This Privacy Policy applies to consumers who are customers or former customers of Brecek & Young Advisors, Inc. (“Brecek & Young”) and our affiliated companies.* Brecek and Young and our affiliated companies are committed to maintaining the trust and confidence of our customers. Brecek & Young companies collect information that helps serve your financial needs, fulfill legal and regulatory requirements, and offer new products or services to meet your specific needs. The following Privacy Policy describes what ‘nonpublic personal information’ we collect, what we do with it, and most importantly, how we protect it.

What Types of Nonpublic Personal Information Do We Collect? When you apply for, open, or maintain an account with us, we collect the following types of information:

  • Information provided by you on account applications and other standard forms. This information includes, but is not limited to, your name, address, telephone number, Social Security number, date of birth, annual income, employment status, and citizenship.
  • Information about your Brecek & Young transactions, including information obtained through those companies that work closely with us to provide you with diverse financial products and services. This information may include account balances, trading activity, loan amount, and payment history.
  • Medical information, if relevant to your product or service, may also be obtained through third-party reports.
  • Information we receive from consumer reporting agencies.
  • Information obtained when verifying the information you provide on applications or other forms (such as from current and past employers or other institutions where you conduct financial transactions).

What Types of Nonpublic Personal Information Do We Disclose? We do not share customer information with outside companies for the purpose of selling their products and services to you. Any information that we, or our affiliates, obtain from you is used only to help you acquire the investment, advisory, or insurance products that you desire from the companies you choose through our representatives. The personal nonpublic information obtained in this process will only be provided to nonaffiliated companies who custody your assets, prepare statements and transaction confirmations for your account, or provide credit reporting information.

In certain instances, Brecek & Young will disclose nonpublic personal information when permitted or required by law or to cooperate with regulators or law enforcement authorities. These parties include government/regulatory agencies, such as the Internal Revenue Service (IRS) and the Securities and Exchange Commission (SEC), as well as any of the federal and state securities regulatory agencies we are registered with and to parties under court order or subpoena that request this information. We are also permitted to make disclosures to third parties per your request, direction, or authorization.

Medical/Non-Medical information may be provided to insurance companies and agencies in order to underwrite or shop policies for reduced policy costs. This information is released only with your express authorization.

If you close your account, in the process of transferring your investments we may share your information with the new broker-dealer or custodian that you or your representative selects. If our representative servicing your account leaves us to join another broker-dealer, the representative is permitted to retain copies of your information so that he or she can assist with the transfer of your account and continue to serve you at the new firm. The representative’s continuing use of your information will be subject to the new firm’s privacy policy.

Opting Out of Third-Party Disclosures: If you do not want us to share your information (other than as prescribed by law) with any nonaffiliated third parties, including the registered representative servicing your account when he or she leaves us to join another firm, you may contact the ompliance Department in writing to: Brecek & Young Advisors, Inc., 1110 Iron Point Road Ste 100 Folsom CA 95630.

How Do We Protect The Confidentiality And Security Of Nonpublic Personal Information? We maintain internal standards and procedures to protect your information and prevent its dissemination to unaffiliated individuals and entities. We restrict access to nonpublic personal information about you to those employees, registered representatives or agents, and other parties who must use that information to provide products and services to you. We have physical, electronic, and procedural safeguards in compliance with applicable laws and regulations to guard your nonpublic personal information. We require that those nonaffiliated companies who perform services on our behalf, including those who custody your assets, prepare statements and transaction confirmations for your account or provide credit reporting information agree to, and implement physical, electronic, and procedural safeguards to keep your information confidential.
